A-15 - The Ethics of Representing Parents with Diminished Capacity   Intermediate


When representing a parent in the dependency court process that is or may be incompetent, parent attorneys may face a dilemma. The parent attorney must follow their client’s direction on the case even if the attorney believes such actions are not in the parent’s best interest. A panel of state-wide parent attorneys will explore their role representing a client with a diminished capacity and how the Washington State Rules of Professional Conduct (RPCs) direct their representation of a client even when that client has been found to be incompetent. Participants in this workshop will leave with a better understanding of the ethical duties of an attorney and the tension parent attorneys may feel when following that parent’s direction for the case.
